In these terms of use, "you" and "your" refer to any user of the Frogans technology mailing lists (lists.frogans.org). By using these mailing lists, you acknowledge having read and accepted these terms of use.
Introduction
1. The Frogans technology mailing lists are provided by the OP3FT, in accordance with its Bylaws, in the context of the promotion, protection and progress of the Frogans technology.
2. The Frogans technology mailing lists are public mailing lists. Hence, messages posted on these mailing lists can be read by anyone, notably via the archives published on the Web site lists.frogans.org, which contain all posted messages.
3. The use of the Frogans technology mailing lists is free of charge.
4. The language of the Frogans technology mailing lists is English.
5. Each Frogans technology mailing list is presented on a Web page of the Web site lists.frogans.org. For example, the Web page presenting the "Early-questions" mailing list is accessible at the following permanent URL: https://lists.frogans.org/early-questions/. The Web page presenting a Frogans technology mailing list contains the general purpose and the supplemental terms of use of the mailing list.
6. Before using a Frogans technology mailing list, you must read the Web page presenting the mailing list and accept its supplemental terms of use. You must also follow the instructions contained in e-mails that you may receive from the system that manages the mailing list.
7. If you have any difficulties using a Frogans technology mailing list, please contact support-lists (at) frogans (dot) org.
8. The OP3FT is not responsible for the content of messages posted by users of the Frogans technology mailing lists.

Use of the mailing list archives
10. The archives of messages posted on the Frogans technology mailing lists are published on the Web site lists.frogans.org at the following permanent URL: https://lists.frogans.org/archives/access.html. You can also access the archives of a mailing list from the Web page presenting this mailing list.
11. You can only use the archives of the mailing lists to find information on topics discussed in the mailing lists. You must not, for any reason whatsoever, collect e-mail addresses nor other personal data from these archives. You must not create a public archive, in any form whatsoever, from the messages contained in these archives.
12. The archives of the mailing lists are available in HTML format. They are not available in "Full text" format.
13. The archives of the mailing lists are updated automatically. Under normal operating conditions, updates occur every 30 minutes. The date of a message contained in the archives matches the date this message was received by the system that manages the mailing lists.
14. Web search engines are permitted to index the messages contained in the mailing list archives.
15. The messages contained in the mailing list archives may include attachments and links to other Web sites. If you find that an attachment poses a security problem or that a link leads to malicious content, you are strongly encouraged to report the problem so that the OP3FT can intervene, notably by removing the message from the mailing list archives. The OP3FT assumes no liability or responsibility for any loss or damage caused by these attachments or by the content published on other Web sites.
Subscription to a mailing list
16. In order to receive by e-mail the messages posted on a Frogans technology mailing list, you need to subscribe to the mailing list.
17. You must also subscribe to post messages on a Frogans technology mailing list, except in the case of the mailing lists used by the OP3FT for public consultations, which do not require subscription.
18. Subscription to a mailing list is via the Web page presenting the mailing list. You only need to supply an e-mail address to register. The e-mail address you supply must belong to you and be valid and active. You must not use the e-mail address of a third party, nor an e-mail address used by multiple users, nor a temporary e-mail address, nor the e-mail address of a mailing list.
19. To validate your subscription, a confirmation request will be sent to you to the e-mail address you supplied.
20. Once subscribed, if you wish to change your e-mail address, you need to unsubscribe from the mailing list using your old e-mail address and resubscribe using the new one.
21. You can subscribe to as many mailing lists as you wish.
22. The OP3FT does not publish the list of users subscribed to a mailing list.
Receiving messages posted
23. Once subscribed to a Frogans technology mailing list, you will receive all the messages posted by the users of the mailing list. You must not, for any reason whatsoever, use the e-mail addresses of users nor other personal data contained in the posted messages, apart from within the context of your participation in the discussions in the mailing list. You must not create a public archive, in any form whatsoever, from the posted messages.
24. The system that manages the mailing lists automatically transmits to you the messages posted by the users. Under normal operating conditions, messages are transmitted within a few minutes. The date of a posted message matches the date this message was received by the system that manages the mailing lists. If a user posts a message having put your e-mail address in the 'to' or 'cc' field, the system will not transmit the message to you as it is assumed that you will receive the message directly from the user.
25. Messages posted by users may include attachments and links to other Web sites. If you find that an attachment poses a security problem or that a link leads to malicious content, you are strongly encouraged to warn the users subscribed to the mailing list by posting an alert if the mailing list allows you to do so, and to report the problem so that the OP3FT can intervene, notably by removing the message from the mailing list archives. The OP3FT assumes no liability or responsibility for any loss or damage caused by these attachments or by the content published on other Web sites.
26. If you wish to temporarily stop receiving messages posted by the users of the mailing list, you need to unsubscribe from the mailing list and resubscribe at a later date.
27. When receiving messages from the system that manages the mailing lists, your E-mail client must not post auto-reply messages, e.g. "out-of-office" absence notifications. If in doubt about the configuration of your E-mail client, you must unsubscribe from the mailing list and resubscribe when you return.
Posting messages
28. To post a message on a Frogans technology mailing list means to send an e-mail from your E-mail client to the e-mail address of the mailing list. For example, to post a message on the "Early-questions" mailing list, you need to write and send a message to the e-mail address: early-questions@lists.frogans.org. You can also post a message on a mailing list by replying to a message that you have received from the mailing list. This creates a discussion thread.
29. You do not need to be subscribed to post your messages on the mailing lists used by the OP3FT for public consultations.
30. You must be subscribed to post your messages on Frogans technology mailing lists other than those used for public consultations.
31. By posting a message on a mailing list, you acknowledge and agree that your message, including your e-mail address, will be transmitted automatically to all users subscribed to the mailing list, regardless of their location worldwide. You acknowledge and agree that once your message is posted, you may not modify or cancel it. If you change your opinion on a topic, and want this to be known, you must post a new message.
32. By posting a message on a mailing list, you acknowledge and agree that you may be directly contacted by e-mail by a user subscribed to the mailing list.
33. By posting a message on a mailing list, you also acknowledge and agree that your message will be published in the mailing list archives on the Web site lists.frogans.org, for an unlimited period of time, even after you have unsubscribed from the mailing list or in the event of the mailing list being closed down, notably so as to keep track of the historical development of the Frogans technology. In the mailing list archives, the display of your e-mail address will be partially masked at the level of the domain name so as to prevent automatic collection by third parties. For example, if your full e-mail address is "John Doe <john.doe@specificdomainname.com>" it will be displayed as "John Doe <john.doe@...>." Correctly formatted e-mail addresses, i.e. with an "@" sign, that appear in the text of messages posted will be partially masked in the same way.
34. After posting a message on a mailing list, you will not receive an e-mail from the system that manages the mailing list to acknowledge receipt of your message. If you are subscribed to the mailing list, the system will send you the message that you posted.
Content of posted messages
35. You undertake to use the Frogans technology mailing lists solely for the purpose of exchanges and discussions about the Frogans technology.
36. Before posting a message on a mailing list, you must consult the Web page presenting the mailing list to take note of its general purpose and to find out if there are any particular restrictions regarding the content of posted messages.
37. You must endeavor to post messages that are clear, well-argued and respectful of other users. You must not under any circumstances post messages containing foul language, intimidation, personal attacks or other content unrelated to the general purpose of the mailing list. If a discussion thread degenerates, avoid responding to provocations. Please note that all Internet users, including Internet users who have not reached legal adulthood in their country, can potentially access the archives of the mailing lists published on the Web site lists.frogans.org.
38. When posting a message on a mailing list, you are responsible for your own personal data that may be included in the content of your message. In particular, it is your responsibility to set your E-mail client so that it does not automatically include your name in the content of posted messages, should you wish such data not to be published.
39. When posting a message on a mailing list, you acknowledge that you are sole responsible for the content of your message and its publication. You undertake to comply with the regulations regarding the publication of online content that are applicable to you. In any case you undertake not to post any messages that: (i) could be seen as SPAM, (ii) are pornographic in nature, (iii) incite violence or racial hatred, (iv) are an affront to human dignity, (v) are an infringement of the privacy or the personal data of third parties, (vi) are an infringement of the intellectual property rights of third parties, (vii) contain or link to dangerous or malicious content such as viruses or worms.
40. The content of messages you post on the Frogans technology mailing lists are contributions governed by the Frogans Technology Development Contributor Policy. You acknowledge and agree that this content may be freely exploited by the OP3FT for any and all purposes to fulfill its public-interest mission in relation to the Frogans technology. Should intellectual property rights be recognized on such content, by participating in the mailing lists, you agree to grant free-of-charge and irrevocably to the OP3FT, and for their entire duration, all the rights to exploit such content including in particular the rights of reproduction, representation, adaptation or distribution, on any media and by any means.
41. You must not include any statement contrary to these terms of use in the content of a message you post on a Frogans technology mailing list. For example, any confidentiality provision or copyright notice inserted in the content of a message will be deemed null and void.
42. Any improper or bad faith use of the Frogans technology mailing lists will be considered a violation of these terms of use. Depending on the severity and/or repetition of your violation, the OP3FT may notably: (i) moderate messages you post on the mailing lists, (ii) temporarily or permanently revoke your ability to post messages on the mailing lists, (iii) cancel your subscription to one or more mailing lists, (iv) temporarily or permanently ban you from re-subscribing to any Frogans technology mailing list.
Unsubscription from a mailing list
43. You can unsubscribe, at any time, from a Frogans technology mailing list to which you are subscribed.
44. Unsubscription from a mailing list is done via the Web page presenting the mailing list. You only need to supply your e-mail address to unsubscribe. The e-mail address you supply must match the one initially supplied to subscribe.
45. To validate your unsubscription, a confirmation request will be sent to you to the e-mail address you supplied.
46. Messages that you may have posted on the mailing list will remain in the archives of the mailing list after your unsubscription.
47. If you stop using the e-mail address that you supplied to subscribe to a mailing list, you must unsubscribe from the mailing list beforehand.
48. If the system that manages mailing lists finds that the posted messages it transmits to your e-mail address are rejected or bounce repeatedly, you will be automatically and without notice unsubscribed from the mailing lists to which you are subscribed. To check that you are still subscribed to a mailing list, you can attempt to subscribe using your e-mail address and the system will tell you whether you are already subscribed or not. The system that manages the mailing lists will not send you e-mails at regular intervals to remind you that you are subscribed to a mailing list.
Messages posted by the OP3FT
49. The OP3FT may post messages on any Frogans technology mailing list.
50. You may use or reproduce any information or document included in a message posted by the OP3FT on a Frogans technology mailing list, subject to any specific terms of use that might appear with such information or document, provided that the use of such information or document is accompanied by an acknowledgment that the OP3FT is the source.
51. The OP3FT makes every effort to ensure, but cannot and does not guarantee, and makes no warranties as to, the accuracy, accessibility, integrity and timeliness of this information and these documents. The OP3FT assumes no liability or responsibility for any errors or omissions in the messages it posts on the Frogans technology mailing lists and further disclaims any liability of any nature for any loss howsoever caused in connection with using these posted messages.
52. A message posted by the OP3FT on a Frogans technology mailing list cannot amend any information or document previously published by the OP3FT on one of its Web sites. In the event of a conflict between the information or a document included in a message posted by the OP3FT and the information or a document previously published by the OP3FT on one of its Web sites, the information or the document previously published prevails.
53. Other provisions
54. These terms of use may be amended at any time and without notice. New terms of use enter into force as soon as they are published on this Web site.
55. The supplemental terms of use of a mailing list may be amended at any time and without notice. You must regularly check the Web page presenting the mailing list for any modifications. By continuing to use a mailing list after an amendment of its supplemental terms of use, you represent having agreed to these new supplemental terms of use.
56. In the event of a conflict between the supplemental terms of use of a mailing list and these terms of use, the latter prevail.
57. Some Frogans technology mailing lists are read-only. Only the OP3FT can post messages on these mailing lists.
58. The OP3FT reserves the right to open and close Frogans technology mailing lists at any time and without notice. The OP3FT also reserves the right to temporarily suspend the functioning of a mailing list.
59. You acknowledge that the OP3FT cannot guarantee the origin of messages posted on the mailing lists, since E-mail technology makes it possible for malicious individuals to post messages while posing as legitimate users, subscribed or not, of the mailing lists. You must remain cautious while consulting messages posted on the mailing lists. If you see an abusive use, you are strongly encouraged to report it so that the OP3FT can intervene, notably by removing the message from the mailing list archives.
60. Given the technical functioning of the Internet, you acknowledge that, at the level of the system that manages the Frogans technology mailing lists, the OP3FT can neither guarantee the reception of messages posted on the mailing list on the one hand, nor their sending out to subscribed users on the other.
61. You acknowledge and agree that the system that manages the Frogans technology mailing list automatically analyzes posted messages in order to detect and isolate messages that could be seen as SPAM or containing viruses or worms in attachments. Messages isolated in this way are analyzed by the OP3FT and are canceled when appropriate. You acknowledge that these operations may delay the sending-out, to subscribed users, of messages that have been automatically isolated in an erroneous manner by the system ("false positives").
62. Under normal operating conditions, the Frogans technology mailing lists, including their archives, are accessible at any time. However, interruptions for technical maintenance may be required. The OP3FT will endeavor to communicate in advance, on the Web site lists.frogans.org, the anticipated date and duration of the maintenance.
63. The system that manages the Frogans technology mailing lists includes the following programs: Mailman, MHonArc and mharc. The user interfaces of these programs are in English.
64. The collection and retention of personal data by the OP3FT through the Frogans technology mailing lists are governed by these terms of use and by the OP3FT Privacy Policy.
65. For legal purposes, the OP3FT retains all messages posted on the Frogans technology mailing lists in their entirety, e.g. to enable traceability of contributions to the development of the Frogans technology. Messages removed from the archives are also retained.
66. In the event of abusive use of the Frogans technology mailing lists, in addition to the provisions set forth in these terms of use, the OP3FT reserves the right to take legal action against involved users.
67. These terms of use are governed by French Law, including applicable European regulations.
